Terms of Service

1. Acceptance of Terms

By accessing or using Fabryard (“the Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Platform. These Terms constitute a binding agreement between you and Fabryard.

2. Eligibility

You must be at least 18 years old to make a purchase or create an account. By using the Platform, you represent that you meet this requirement. If you are under 18, you may only use the Platform with the involvement of a parent or guardian.

3. Account Registration & Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at our contact page if you suspect unauthorised access. We reserve the right to suspend or terminate accounts for violation of these Terms.

4. Orders & Payments

All prices are listed in Nigerian Naira (NGN) and inclusive of applicable taxes. An order is confirmed only when payment is successfully processed. We reserve the right to cancel any order due to stock unavailability, pricing errors, or suspected fraud. In such cases, a full refund will be issued.

Payment is processed securely through Flutterwave. We do not store credit or debit card numbers on our servers.

5. Pricing & Availability

Fabric images are for illustration purposes only. Colours may vary slightly due to screen calibration and lighting. We make every effort to display accurate colours but cannot guarantee exact matches. Stock levels are updated regularly but may occasionally be inaccurate.

6. Shipping & Delivery

Shipping costs and estimated delivery times are calculated at checkout and are based on the shipping zone selected. Delivery times are estimates and not guaranteed. We are not liable for delays caused by third-party carriers, customs processing, or force majeure events. Risk of loss passes to you upon delivery to the carrier.

7. Returns & Refunds

Returns are accepted within 14 days of delivery for unused fabric in its original condition and packaging. Custom-cut fabric, clearance items, and swatch samples are non-returnable. To initiate a return, contact us through our contact page. Refunds are processed to the original payment method within 5–10 business days after we receive and inspect the returned item.

8. Intellectual Property

All content on the Platform — including product images, fabric designs, text, logos, and software — is the property of Fabryard or its licensors and is protected by Nigerian and international intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written consent.

9. Prohibited Uses

You agree not to use the Platform for any unlawful purpose, to attempt to gain unauthorised access to any part of the Platform, to interfere with the proper functioning of the Platform, or to engage in any activity that could damage, disable, or impair our infrastructure.

10. Disclaimer of Warranties

The Platform and all products are provided “as is” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. To the fullest extent permitted by applicable law, Fabryard disclaims all warranties.

11. Limitation of Liability

To the maximum extent permitted by law, Fabryard shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform or any products purchased, even if advised of the possibility of such damages. Our total liability shall not exceed the amount paid by you for the product giving rise to the claim.

12. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, third parties, or our business interests. Upon termination, your right to use the Platform ceases immediately.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved within 30 days, it shall be referred to mediation at the Lagos Multi-Door Courthouse before any court action is commenced. Either party may seek injunctive relief from a court of competent jurisdiction in Lagos, Nigeria.

14. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Continued use of the Platform after changes constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
